I know it's listed as TBA but is it actually going to come out or not? Is it possible we'll see it out before the end of the year or is it such a bad seller I might as well just consider it dropped and go find some scanlations?

Acording to Amazon, the second volume comes out on Dec 30, 2009

so is it true or is it a mistake?

The listing is incorrect. We don't have the rights to the second volume.

Interestingly, both Amazon.ca and Chapters.ca list vol 2 as a July 1, 2009 release. Perhaps you should get them to take down the erroneous listings as they are causing some confusion.
